Our General Terms & Conditions
True Paving Inc. will provide a price quote upon request, based on the actual square footage of the area and what type of paving is being done, this is done to the best of our ability based on what is visible at the time of the quote. Once the quoted price is accepted by the customer, we will require a 50% deposit to accept the job & begin filing for the permits/approvals. The remaining 50% balance is due the day we complete the job, no exceptions.
We do charge a different price per square foot for the removal of cement/concrete versus asphlalt and grass. There is a very small chance that once we begin a job there will be an unforseen layer under the asphalt that will change the price. For example; when we begin a dig (tear-out) at a property we may find several other layers underneath the asphalt, if any of those layers happen to be cement/concrete this will change the price of the job, even if the work has begun already. While this is a very rare occurance, it does happen especially with older properties that have been paved over (overlay/resurface) previously.
True Paving Inc. will not be responsible for yard/grass damage if crossing the yard is necessary to get to the area to be paved. We are not responsible for any damage to concrete, paver bricks, garage floors, treated or stained concrete, sidewalks, existing asphalt, or siding caused by equipment crossing, rolling, driving, across/over it (or touched in any way by normal installation) although we will make every effort to be as careful as possible we cannot guarantee there will be no marks.

True Paving Inc. has the confidence to stand by its work with one of the strongest warranties in Western New York. All Asphalt Installation work performed comes with a 2-year workmanship & materials limited warranty from the date of installation. True Paving Inc. guarantees their material and workmanship against defects for a period of 2 years if asphalt is maintained per our guidelines.
To contact us with a possible warranty issue; True Paving Inc. must be notified by email at: warranty@TruePaving.net The submission email must include pictures and a breif description of the issue, when you first saw it & must be submitted no more than (10) days of first knowledge of defect by customer or customer’s agent.
All warranties subject to the following conditions:
Damage caused by impact or exposure to/from any foreign object or substance or other mistreatment of paved surface will not be covered. This includes, but is not limited to: motorcycle stands, dumpsters, jacks, kick stands, lawnmowers and even things such as lawn chairs & pop-up canopies. Oil, gas or vehicle fluid spills that damage asphalt & tire marks are not covered under any warranty. Acts of nature that can cause damage to pavement are also not covered under this warranty. This includes, but is not limited to: ground movement, drought or compaction of the earth’s soils, root systems of surrounding landscapes or any natural growth (this includes ALL vegetation), oxidation through ultraviolet rays, and ground water swelling under pavement causing undue moisture of pavement base. Asphalt Protection-
Failure to add a layer of seal-coating protection to newly installed asphalt within 1-Year of install (& maintain that coating over the life of the asphalt) will result in pre-mature aging, cracking, oxidation through ultraviolet rays & heat stress damage. These will not be covered under warranty.
True Paving Inc. will not be responsible for yard/grass damage if crossing the yard or driveway is necessary to get to the area to be paved or if homeowner wants to keep any materials from job site and crossing the yard or driveway is necessary. We are not responsible for any damage to concrete, paver bricks, garage floors, treated or stained concrete, sidewalks, existing asphalt, or siding caused by equipment crossing, rolling, driving, or normal installation is not covered although we make every effort to be as careful as possible.
All material is bought and owned by True Paving Inc. until project is completed and final payment is made. If work is not paid in full in its entirety at completion this warranty is null & void.
True Paving Inc. reserves the right to repair or replace workmanship & materials at our discretion in any all area(s) of concern.
If any contractor other than True Paving Inc. does any work to the driveway during the warranty term this guarantee is null and void.
Grading & Pitch-
It all comes down to the following: Materials are provided by the use of computerized asphalt plants to guarantee consistency of asphalt cement, heat, and various mixtures of aggregates. Workmanship means asphalt thickness is as designated, along with proper compaction and drainage. Swales (shallow channels carved out) and berm (raised beds to aide in pushing water to a swale), this is just basically convex & concave channels & may be used to assist in drainage issues as well as skin lift asphalt patches if necessary.
Industry standards include the possibility of 1/2″ ponding of water that may occur if grades are at or below minimum asphalt standards of .25 per foot pitch (2% grade). If there is any greater than 1/2" standing water after a 48 hour period this constitutes a drainage issue and will be addressed if less than 85% water drainage.
Warranties do not include acts of nature, (cracks, breakage, settling, heaving or unraveling). Underground wires, pipes, utilities, culverts, weeds, tree roots, and inadequate sub-base installation done by others are some other causes of asphalt failure not covered under this warranty. Excessive weight or driving on or near unsupported edges that crack or break are also not covered. When paving there are certain areas that have to be installed by hand, therefore, areas may appear more course than others.
Seal-Coating-
Sealcoating, crack sealing and line striping carries a 90 day limited warranty. This warranty does not cover damage due to sprinkler systems left on during or after installation, tire marks, weather related damage (rain, wind, etc.) & people or animals walking across wet sealcoat or paint.
There is no warranty on pothole repair or asphalt repairs in parking lots or driveways.
True Paving Inc. has the right to refuse or alter any warranty at time of bidding or quoting the job with disclosure of change written on proposal.
